Larry Dogbey appeals custodial jail term
Larry Dogbey, Managing Editor of The Herald newspaper, has filed an appeal challenging a seven-day custodial term imposed on him by a High Court. He is asking the Court of Appeal to set aside his conviction and sentence, and declare the interlocutory injunction order void or alternatively substitute the custodial sentence with a non-custodial one.
Dogbey contended that the trial judge should not have granted the injunction, and that the order itself was vague and incapable of clear compliance. He also challenged the trial court's application of the standard of proof in the contempt proceedings, arguing that contempt must be proved beyond reasonable doubt and that the judge wrongly shifted the burden onto him. Dogbey stated his publications were based on a Supreme Court decision delivered on February 11, 2026, and official documents from EOCO and the Ministry of Energy, arguing that convicting a journalist for reporting on these amounted to an unconstitutional gag order, contrary to Articles 162 and 165 of the 1992 Constitution. The High Court, presided over by Justice Isaac Addo, found him guilty of disregarding an injunction order.
