Samson Lardy Anyenini explains why Court of Appeal overturned Sedina Tamakloe's conviction in MASLOC case

Samson Lardy Anyenini explained the reasoning behind the Court of Appeal's decision to overturn the conviction of former Microfinance and Small Loans Centre (MASLOC) Chief Executive Officer, Sedina Christine Tamakloe-Attionu. He stated that the appellate court's decision was based largely on its finding that the prosecution failed to prove its case beyond reasonable doubt, as required in criminal trials. Anyenini explained that Sedina Tamakloe-Attionu's appeal challenged both the substance of the High Court judgment and the validity of several charges brought against her.

The state had argued that defects in some charges were merely technical and should not have resulted in the conviction being overturned, but the Court of Appeal ruled that the defects were fundamental and affected the fairness of the proceedings. Anyenini also explained that the state argued Sedina should not have been allowed to benefit from the appeal process because she had not participated in the original trial, having been convicted in absentia after leaving Ghana. However, the Court of Appeal disagreed, holding that an appeal is a constitutional right.
