"Nobody has the right to choose when or how they are arrested" - lawyer
Justice Abdulai, a private legal practitioner, stated that no suspect has the legal right to determine when, where, or how they should be arrested, provided law enforcement agencies act within the confines of the law. He said, "No one has a right to determine when and how he is arrested. So long as it is within the law, and due process is followed in effecting the arrest, you cannot determine how, where and when you should be arrested." His comments were made during an interview on Joy FM's Top Story amid public debate over the arrest of Dennis Edward Aboagye by the Economic and Organised Crime Office (EOCO).
Justice Abdulai acknowledged that an arrest should not be carried out in a manner intended to embarrass or attract unnecessary public attention. He added that if a suspect was under investigation, had been reporting, and had not suggested they were absconding, then an arrest could have been made at a more appropriate time before they attempted to travel. He also noted that investigators ordinarily impose conditions on suspects granted bail, including restrictions on movements, and typically inform suspects they cannot leave a specified jurisdiction without notifying investigators.
