JG Resources Limited saw a judicial setback for Sesi-Edem Company Limited's contempt application when Justice Doris Awuah Dabanka-Bekoe dismissed it. The Commercial Court found no legal foundation for imprisoning Papa Yaw Owusu-Ankomah, Kwaku Appiah Yeboah, and Maame Akosua Asama Kuranchie, stating that "the law does not command the impossible." Personal service had not been properly established, deliberate disobedience had not been proved, and the respondents' explanation of bank account restrictions making compliance impossible remained unrebutted.
The bank statements relied upon by Sesi-Edem did not establish contempt, as some transactions predated the court order and others did not conclusively relate to the disputed Sale and Purchase Agreement. JG Resources views this as confirmation that allegations cannot substitute for proof when liberty is at stake. In the wider dispute, JG Resources maintains it fulfilled financial obligations for an agreement involving 50 kilogrammes of gold, but public delivery figures of approximately 29.2 kilogrammes, 30.8 kilogrammes, and 32.8 kilogrammes remain below the contracted quantity.
